论刑事诉讼证人保护制度及其完善

我国刑事诉讼法规定，凡是在诉讼之外了解案件情况的人都负有作证的义务。但是在司法实践中，证人的出庭率却相对较低，证人大多数选择书面作证，使得证词缺少说服力，有时证人会顾虑出庭会导致其人身财产受到不法侵害，从而选择不出庭作证。我国虽然规定了相应的证人保护制度，但是大多数保护制度都是宣示性的，缺少细节化的规定。因此，应当加快证人保护的专门立法，设立专门的证人保护机构，进一步加强对证人的保护力度，以完善我国刑事诉讼法律体系，贯彻法制理念，从而达到建设社会主义法治国家的最终目的。
