夫妻财产约定制在国外立法例中已有较完善的规定，完善夫妻约定财产制度具有增强对夫妻合法财产权益的保障、保障第三人债权的实现、维护第三人的利益、节约司法资源、提高诉讼效率的作用，亦为我国建设和谐社会和司法实践所需，我国应逐步完善夫妻财产制度。我国现行的《婚姻法》关于夫妻财产约定的订立、生效时间、内容及其变更、撤销规定不明确，没有建立夫妻财产约定登记制度和公示制度，亦没有对第三人债权受夫妻财产约定侵害的救济方式和责任归咎进行规定，我国应该在今后《婚姻法》的修改中对这几个方面的规定加以明确，增加相应的登记和公示制度，才能建立完善的夫妻财产约定制度。关键词：夫妻财产约定；缺陷；第三人权利；完善建议

夫妻约定财产制就是指法律允许夫妻用契约、协议的方式对他们在婚前和婚后财产的归属、占有、管理、使用、收益和处分以及对第三人债务的清偿、婚姻解除时财产的分割等事项做出约定从而排除或部分排除夫妻法定财产制适用的制度。夫妻之间的财产约定是对夫妻双方都具有拘束力的契约。夫妻约定财产制度体现了平等、自愿的契约自由原则，同时夫妻之间对财产的约定在本质上是合同，在约定的形式、效力、解除等方面一定程度上也要受《合同法》的影响。这是在法律层面保障夫妻双方和第三人财产的有力依据。人民生活水平的不断提高，公民个人的家庭财产r
