要
通说认为房屋租赁权具有债权的属性，然而无论是从房屋租赁权具备的实质要件还是从保护房屋承租人的角度考虑，房屋租赁权均应当属于一种物权，而且是一种自物权之外的他物权。这个对于解决房屋承租人与房屋共有人优先购买权的竞合有着前提性的意义。由此前提下，并且综合考虑各种因素，可以认为房屋共有人的优先购买权拥有较之房屋承租人之相应权利更高的效力。笔者认为这样可以取得更好的社会效果。
