论我国经济犯罪死刑制度的废除
摘要从我国的现行刑罚体系上看，我国对经济犯罪采取了重刑主义，对多个经济犯罪设置了死刑刑罚，司法上死刑判决也屡见不鲜。而实践上并没有到达预期的后果，多数经济犯罪并没有因为死刑的设置而减少，沿用多年的经济犯罪死刑设置越来越暴露出更多的问题。此外，随着我国法治进程和人权主义进一步发展、民意的嬗变以及一直以来对经济犯罪死刑可罚性争议，废除经济犯罪存在合理的基础。就我国现阶段国情而言，部分经济犯罪适用死刑的弊远大于利，应该区别废除经济犯罪死刑制度。在废除大部分经济犯罪死刑的同时，有必要在保留少部经济犯罪。本文将着重分析我国经济犯罪废除死刑的合理性，并对全面废除死刑提出可行性设计和意见。关键词经济犯罪死刑废除保留民意
