三年多的司法实践中遇到的一些具体问题，并提出了自己的一些解决对策。具体包括：职工卖断工龄款、各类比赛奖金的归属；用夫妻共同财产购买的一方专用生活用品是否一概认定为个人财产；父母为子女结婚购房或夫妻婚后购房所给付的购房出资是否均构成对子女的赠与；父母为夫妻婚后购房出资，产权登记在夫妻一方名下，是否可认定为父母的出资是明确表示为对夫妻一方的赠与；继承权可否单方放弃；个人特有财产的添附；夫妻一方婚前以个人财产按揭购买期房，婚后共同还贷，该房屋产权属夫妻共有还是个人所有；未经另一方授权亦无约定之义务，夫妻一方对另一方的个人财产进行管理，其性质是否属于无因管理；夫妻约定婚后所得财产全部归一方所有是否有效；在企业工商登记资料中记载的股权比例可否认定为夫妻对财产份额的约定；不具有完全民事行为能力人的监护人是否可以代理其订立夫妻财产契约；夫妻婚后以共同财产购买产权的一方婚前承租的公有房屋，离婚时其公有房屋使用权的价值是否应当考虑；离婚时有关农村承包经营权的处理问题。r
