f摘要
宪法作为国家的根本法和治国安邦的总章程，是一国法律体系的核心。宪法的生命不仅在于她的庄严，更在于她的实施，宪法的实施又依赖于违宪审查机制的建立和完善。违宪审查制度是现代法治国家法律体系的重要组成部分，是衡量一国法治水平的重要标志。我国现行宪法对违宪审查制度虽有明文规定但却存在诸多不完善的地方，致使违宪审查制度缺乏有效性及可操作性。表现在宪法解释权和违宪审查权相分离，多头违宪审查体制，违宪审查缺乏程序保障等等。加之一些其他因素使中国的违宪审查终始只是停留在纸面上。为了保证宪法的有效实施维护宪法权威，实现真正意义上的依法治国，必须尽快构建具有中国特色的违宪审查。
